Elles auront un d\u00e9lai suppl\u00e9mentaire de deux ans. Si en 2032, les grandes entreprises n\u2019ont pas adopt\u00e9 cette proportion, elles risquent de se voir appliquer une p\u00e9nalit\u00e9 financi\u00e8re pouvant aller jusqu\u2019\u00e0 1 % de la masse salariale.<\/p><p>\u00a0<\/p><p>Cette nouvelle proposition de loi, visant \u00e0 promouvoir l\u2019\u00e9galit\u00e9 homme-femme au travail, intervient 10 ans apr\u00e8s la loi Cop\u00e9-Zimmermann, qui demandait 40 % de femmes dans les conseils d\u2019administration des entreprises de plus de 500 salari\u00e9s. Quota qui a fonctionn\u00e9 puisqu\u2019en 2013, seulement 26 % des si\u00e8ges d\u2019administrateurs, au sein des 120 plus grandes soci\u00e9t\u00e9s cot\u00e9es en Bourse, \u00e9taient occup\u00e9s par des femmes, contre 43.6 % en 2019, 6 ans apr\u00e8s. On notera donc que la mise en place du quota a permis une belle progression en faveur de l\u2019\u00e9galit\u00e9 !<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-bdbcfcf elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"bdbcfcf\" data-element_type=\"section\" data-e-type=\"section\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\n\t\t\t\t\t<div class=\"elementor-column elementor-col-100 elementor-top-column elementor-element elementor-element-47a5fe5\" data-id=\"47a5fe5\" data-element_type=\"column\" data-e-type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t<div class=\"elementor-element elementor-element-be9d468 elementor-widget elementor-widget-text-editor\" data-id=\"be9d468\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Le dernier <a title=\"Publication \u00e9galit\u00e9 homme femme equilab\" href=\"https:\/\/equileap.com\/equileap-reports\/\" target=\"_blank\" rel=\"noopener\">rapport du cabinet Equileap<\/a>, place par ailleurs la France en premi\u00e8re position concernant l\u2019\u00e9galit\u00e9 homme-femme dans le milieu professionnel, apr\u00e8s avoir analys\u00e9 pr\u00e8s de 4 000 entreprises sur 23 march\u00e9s. Depuis 1976, l\u2019Insee observe une baisse de l\u2019\u00e9cart entre les salaires de 0.3 points par an en moyenne. \u00c0 ce rythme, il faudra encore plusieurs d\u00e9cennies avant que l\u2019\u00e9galit\u00e9 salariale ne soit atteinte. Concernant l\u2019accession \u00e0 certains postes, les m\u00e8res ont en moyenne une probabilit\u00e9 inf\u00e9rieure de 60 % \u00e0 celles de p\u00e8res pour acc\u00e9der au 1 % des postes les mieux r\u00e9mun\u00e9r\u00e9s. Si les lois n\u2019encouragent pas les entreprises \u00e0 la parit\u00e9, fort est \u00e0 parier que nous pourrons encore attendre un si\u00e8cle, voire plusieurs, avant d\u2019acc\u00e9der \u00e0 cette fameuse \u00e9galit\u00e9. Soyons fi\u00e8res d\u2019\u00eatre des femmes quotas.<\/p><p>Certains diront que l\u2019attribution de poste ne se fera donc plus sur les comp\u00e9tences, rappelons-leur, encore et toujours, cette belle citation de Fran\u00e7oise Giroud : \u00ab La femme serait l\u2019\u00e9gale de l\u2019homme le jour o\u00f9, \u00e0 un poste important, on d\u00e9signerait une femme incomp\u00e9tente \u00bb. Au Medef, Geoffroy Roux de B\u00e9zieux, le pr\u00e9sident de l\u2019organisation patronale, a notamment parl\u00e9 des postes sans rotation automatique : \u00ab il faut que les gens d\u00e9missionnent ou qu&rsquo;ils soient licenci\u00e9s. Si on licencie des hommes pour faire de la place aux femmes, il y a un probl\u00e8me de discrimination \u00bb et de \u00ab l\u00e9galit\u00e9 \u00bb. Lorsque la femme r\u00e9clame une part du g\u00e2teau, il y a toujours cette id\u00e9e qu\u2019elle va prendre la part d\u2019un homme. Or, nous ne voulons pas manger la part d\u2019un autre, juste b\u00e9n\u00e9ficier de la part qui nous revient.<\/p><p>\u00a0<\/p><p>Rappelons qu\u2019en droit du travail : \u00ab La discrimination est le traitement in\u00e9gal et d\u00e9favorable appliqu\u00e9 \u00e0 certaines personnes en raison notamment, de leur origine, de leur nom, de leur sexe, de leur apparence physique ou de leur appartenance \u00e0 un mouvement philosophique, syndical ou politique \u00bb.<\/p><p>\u00a0<\/p><p>L\u2019objectif de ces lois n\u2019est pas d\u2019\u00e9carter les hommes, pour les remplacer par les femmes. Il est simplement d\u2019atteindre l\u2019\u00e9galit\u00e9 et qu\u2019\u00e0 comp\u00e9tences \u00e9gales, une femme ne soit pas discrimin\u00e9e de par son sexe, ce qui est aujourd\u2019hui le cas. Or, faire partie de l\u2019autre sexe ne diminue pas la valeur de l\u2019\u00eatre humain.
